Please do not unlock the extended business functions of the application of Dimond Pony Trading if you do not consent to the collection and use of personal information required to provide services other than the basic functions.

3 . Our realization methods of personal information rights include but are not limited to access, correction, deletion, cancellation, rejection of personalized display, timely response, etc., so as to ensure that you realize your control over your personal information.

8 . Neither party shall be liable for the impossibility, unnecessary or meaningless performance of the Policy due to force majeure or other accidents. Force majeure as mentioned in the Policy refers to unforeseeable, unavoidable and insurmountable objective conditions, including but not limited to war, typhoon, flood, fire, lightning, earthquake, strike, riot, legal disease, hacker attack, cyber virus, technical regulation of telecommunications department, government action or any other natural or man-made disaster.

9 . Using the platform of Dimond Pony Trading means accepting the service agreement and all its attachments of Dimond Pony Trading.

10 . Dimond Pony Trading reserves the right of final interpretation of the Policy.

11 .We will process your personal information in strict accordance with the Policy and your consent. You should stop using the products and/or services of Dimond Pony Trading if you disagree with the Policy.


I. How do we collect your information


1. We collect and use your personal information based on the principles of legitimacy, minimum necessity and transparency, and for the purposes described in the Policy. Please note that you need to register an account of Dimond Pony Trading before logging in if the email you provided has not been registered on the platform.

(3)We will send the verification code to the email after providing us with the email address you used for registration if you forget the login password and need to retrieve the password. You can enter a new password and log in again after successful verification.

(4)The ownership of the account of Dimond Pony Trading platform (i.e. the user ID of Dimond Pony Trading platform) belongs to Dimond Pony Trading platform. User obtains the right to use the account of Dimond Pony Trading platform after completing the application for registration. Users should provide timely, detailed and accurate personal or enterprise information, and update the registration information constantly. Please ask the co-organizer of the activity you participate in in detail if the upload of personal information is involved.

1.1.2 Real-name authentication and identity authentication of recruiter’s employees

(1) Real-name authentication of recruiting user:

You need to fill in the enterprise ABN or ACN to upload the registration license for enterprise verification with your separate consent according to the requirements of laws and regulations to ensure the authenticity of the identity of the position publisher and the requirements of completing the real-name authentication if you register or are invited to register by yourself as a recruiting user.

(2) Identity authentication of the employee of recruiting user:

The recruiter needs to fill in the name and location of the enterprise and select the title while registering. You need to issue the business license of your enterprise, and your enterprise will be set as a certified enterprise after approval. You may need to provide authorization documents for enterprise recruitment to complete the identity authentication of the employee of the recruiting user according to the actual situation of the product in addition to providing the above information to ensure the safety of recruitment. The specific requirements shall be subject to the actual situation. You can also provide us with corporate email for authentication. We will send an authentication email to the email and ask you to complete the authentication of the suffix of the corporate email in steps to ensure the authenticity of your identity on behalf of the recruiting enterprise.

You understand and agree that the recruiting user who has not passed the above real-name authentication and the identity authentication of the employee of the recruiting user cannot enter the platform for operation.

(3) We may need job-seeking user to provide real name, passport or driver’s license for verification with its separate consent to improve the security of your account and protect the job hunting and recruitment security of other users if its account is identified as a high risk (including fraud or publishing illegal information)

(4) Users of the labor service company need to provide us with the identity and enterprise information (including the real name, enterprise ABN and labor license of the recruiter) and upload the business license for authentication with its separate consent to ensure the safety of recruitment.

1.1.3 Fill in the resume

(1) Job-seeking user can fill in one or all of the following information in the resume according to its own wishes while creating/editing resume with the function of job hunting in the products and/or services of Dimond Pony Trading.

Basic information: name, gender (optional), age (interval, and optional), marital status (optional), current country, current residence address (optional), residence status, highestqualification, relevant qualification or skill, English level, contact number and email address.

1) Job intention: expected position, expected industry, expected workplace, salary, job nature (full-time/part-time/internship), do you need the employee to provide sponsorship, total working experience (range), working experience in related work (range), working experience in related work in Australia (range), working experience of doing relevant work abroad (range).

2) Educational experience: educational background, school name, major, in-school time (including dates for enrollment and graduation), and whether the current educational experience is overseas learning experience.

3) Work/internship experience: company name, position name, on-the-job time (including dates for induction and resignation), job description \ select whether the current work experience is overseas work experience.

4) Professional skills (optional, including skill name, duration and mastery degree).

5) Self-appraisal

1.1.4 Please note that we will use your personal information in the following scenarios if you are a job-seeking user:

(1) You can decide to send your resume to a specific enterprise after completing for recruiting users to screen, conduct background review or career selection. Recruiting user to whom you send your resume can see your complete resume only after logging in to the system or downloading your resume to the local device terminal. Recruiting user can see your contact information for contacting you directly for the interview only after recruiting user sends you an interview invitation and you agree to the interview invitation.

We understand that, as a job seeker, you may want more companies to see your resume.Therefore, you can set your resume to “Public” and allow recruiting users tosearch your resume actively to increase your job opportunities. At the moment,settingyour resume as “Public” means that you agree that we provide part of yourresume to the recruiting users; setting your resume as “Visible only to companiesthat have already applied” means that you agree to provide your resume to therecruiting users who have applied; setting your resume as “Hide my resume” meansyour resume will not be searched by the recruiting users.

(2) Recruiting users can query and browse your resume, but shall be bound by the corresponding service agreement, and your resume and other personal information will not show your contact information when displayed to recruiting users.

(3) Recruiting uses who are interested in you can send you a request for your resume or an invitation for an interview. Recruiting user will not be able to know your contact information unless you accept the interview sent by the recruiting user.

(4) We provide recruiting users with the function of downloading job seekers’ resumes in the platform system and downloading them to the local terminal equipment of recruiting users to facilitate the communication between recruiting users and job seekers on the platform and meet the needs of both parties. Please know that the recruiting user can know your complete resume (excluding contact information) and download your complete resume (excluding contact information) after you agree that the recruiting user can view the complete resume. Recruiting user can browse your complete resume and contact information, download your complete resume and contact information, and contact you offline for interview after you agree to the interview invitation.

(5) We will not share your resume with any third party without your consent in addition to the above circumstances. We will inform you which recruiting uses require to check your complete resume and send you interview invitation through the function setting in the web page of Dimond Pony Trading or email notification. However, your resume cannot be searched and downloaded by recruiting users if you set your resume status to “Hide my resume”.

You can submit your resume to recruiting units through us or to the recruiting units directly in offline recruitment activities. It is deemed that you agree that we provide your personal information to the enterprise if you provide the above information by yourself in the case.

You understand and agree that you must ensure that you have obtained the consent of the concerning subject before providing others’ personal information.


1.2 We may need to collect your following information to provide you with better quality and better experience of products and/or services of Dimond Pony Trading. Your refusal to provide the following information will not affect your normal use of the basic service functions of Article 1.1, but will result in our inability to provide you with corresponding extended business functions and services. Please note: please ensure that you have obtained the consent of the concerning subject if the personal information you provide is not your own.

1.2.1 Personal information you voluntarily provide in the process of providing you with products and/or services

1.2.1.1 Improve enterprise introduction

Recruiting user can upload the corporate logo (optional), choose to use ASIC for authentication, and fill in the contact name and contact information to show corporate image to job seekers.

1.2.1.2 Questionnaire survey

In order to provide you with better service and network environment, you can choose to participate in the questionnaire survey sent by us to your mobile phone number or email for registration through a variety of ways (including SMS and email notification) for us to know your use preference, professional preference, attitude, interest, feedback and opinions related to products. The survey results will be used for statistical purposes only. Please fill in your contact information for us to follow up the relevant contents of the survey to you. Not filling in the questionnaire will not affect you to fill in other questions in the questionnaire. In addition, please be aware that refusing to fill in the questionnaire will not affect your normal use of other services on the platform.

1.2.1.3 Online communication record

Both recruiting users and job-seeking users can communicate with each other through the system, and there will be status and message display on their personal platform.

1.2.1.4 Personalized push function

We may send messages to you through the mobile phone number and e-mail provided at register in combination with your browsing preferences to send you notices about your account, products and service, recommend products you may be interested in, and better provide services to you.

We may also send you the latest news of products and/or services, relevant management and other service notices we think necessary to inform you through SMS, on-site notice, e-mail, etc.

We may also associate your browsing records, job intention, user equipment ID collected by us, user ID generated by the system and delivery records, recommend and show job-seeking users more suitable positions or other products and/or services OF Dimond Pony Trading through data analysis as permitted by laws and regulations. You can click the button for smart recommendation to improve your job hunting efficiency and increase interview opportunities. What’s more, we will provide you with a path to turn off the function in the manner described in Article 4.5.2 of the Policy.

We may also associate the browsing record, recruiting position released and user ID of the recruiting user to recommend and display the resume of the job seeker through data analysis, but the contact information of the job seeker will not be displayed here.

1.2.1.5 Extended function based on clipboard

We will read the contents of your clipboard locally when you use the function of clipboard, so as to paste the contents you copied quickly and improve your input efficiency; or jump to the specified page directly for your convenience after you copy the link and open the webpage. For the avoidance of doubt, the contents of the clipboard will not be uploaded to the cloud.

1.2.1.6 Complaint and Feedback

You can fill in and describe your feedback and upload relevant picture information for us to help you solve the problems quickly if you have any advice or suggestions in the process of using the products and/or services of Dimond Pony Trading, or you need complaints and feedback. You can leave your contact information at your option, so that our customer service staff can get in touch with you in time when they need to check the information. Failure to provide the above information will not affect your normal use of products and/or services of Dimond Pony Trading, but it may cause us to be unable to feed back the results of your complaint or consultation timely, or contact you to further verify your feedback or complaint. You understand and agree that your call with Dimond Pony Trading may be recorded.

1.2.2 Personal information we collect actively in the process of providing you with products and/or services

We will collect and use the following information generated in the process of using the products and/or services of Dimond Pony Trading on the premise of compliance with laws and regulations to ensure the security of your account, troubleshoot abnormalities and provide you with better services:

We will collect your personal information on commonly used device, screen size, system version, installed application list, MAC address, device location (IP address,) while using the platform, and correlate these device information to conduct statistical analysis, troubleshoot abnormal information, provide you with consistent services and better user experience.

Dimond Pony cannot prohibit the accessed third-party interface from obtaining your device identifier, MAC address and device location, but restrict the third-party interface from collecting personal information after you agree to “Dimond Pony Trading privacy policy”.

1.2.2.2 Log information

We will collect the detailed information of your use of the platform automatically and save it as a network log according to the requirements of relevant laws and regulations when you use the platform, including delivery records, diagnosis,breaking up, click events, success or failure, browsing records and click records, and save them in accordance with relevant legal requirements to count the use of the platform, optimize the products and/or services of the platform and provide users with a better experience.

1.3 Other grounds of legality other than consent

Special note: recruiting user can search your resume based on the demand once the job-seeking user creates and publishes the resume through the platform. Recruiting can’t view the complete resume, but only the basic information. Please refer to Article 1.1.3 of the Policy for details on how you can disclose the complete resume to the recruiting users or hide your resume.

Some services will be provided by the partner to provide you with more perfect and high-quality products and services. We may share some of your personal information with the partner with your separate consent. We will only share your personal information for legal, legitimate, necessary, specific and clear purposes, and will share the personal information necessary to provide services for you only. We will not share personal information that can identify you unless otherwise stipulated by laws and regulations. The partner of such sharing is the data controller, who will obtain your consent and process your personal information in its own name. We recommend that you read and abide by the user service agreement and privacy policy that the partner may have. Your refusal to collect the personal information necessary for providing services when our partner provides services may result in your inability to use products and/or services of Dimond Pony Trading to access to the services provided by the partner.

Please be aware that we will require the recruiting users to destroy the service and products (including but not limited to resume) obtained from the platform strictly after the recruitment service, and require them not to use the above contents for any purpose other than their own recruitment, disclose or authorize to any third party in any way.


3.3 Transfer

In principle, we will not transfer the control of your personal information to other companies, organizations or individuals. The company and organization will ask you for authorization and consent again in case of merger, acquisition, bankruptcy or liquidation involving the transfer of personal information and any change in the processing method.

Unless otherwise provided by laws and regulations, we will inform you of the purpose, type and transferee of the transferred information (we will also inform the content of the sensitive information involved separately if sensitive information is involved) before the transfer, and transfer with your consent. The changed operating entity will continue to perform the responsibilities and obligations of the personal information controller; we will delete or anonymize your personal information if the company goes bankrupt or shuts down without receiver.

The details shall be subject to the actual page of the product.

4.1.3 Unless otherwise provided by laws and regulations or otherwise agreed in the Policy, you can contact us through the methods described in the Policy if you want to access or correct your other personal information, or encounter difficulties in exercising the above rights. We will respond to your request after verifying your identity.


4.2 Delete your personal information

4.2.1 You can request us to delete your personal information except for the data that has been anonymized or otherwise specified by laws and regulations in the following circumstances:

4.2.1.1 The purpose of processing has been achieved, cannot be achieved, or is no longer necessary to achieve the purpose of processing;

4.2.1.2 We cease providing products or services, or the shelf life has expired;

4.2.2 Job-seeking users who want to delete their resume can delete the resume through the function of “Delete resume” in “My resume” on the website of Dimond Pony Trading. You need to contact the customer service staff in the way described in Article 9 of the Policy to prevent the loss of information caused by incorrect operation.

4.2.3 We reserve the right to close the account that has not been logged in for more than 6 months, and have the right to modify or terminate the service (or any part thereof) temporarily or permanently at any time without further notice. Dimond Pony Trading shall not responsible for users and any third party.

4.2.4 You agree that Dimond Pony Trading can terminate your password, account or the use of the service (or any part of the service) for any reason (including but not limited to prolonged non-use, or DP’s belief that you have violated the letter and spirit of “Service Agreement”) based on its own consideration, remove and delete any content you have in the service. You agree that the services provided under any provision of the “Service Agreement” can be interrupted or terminated without prior notice. You acknowledge and agree that Dimond Pony Trading can close or delete your account, all relevant information and documents in your account immediately, and prohibit you from continuing to use the above documents or the service. In addition, you agree that Dimond Pony Trading will not bear any responsibility to you or any third party due to the interruption or termination of the use of the service, the closure or deletion of your account, relevant information and documents.

4.2.5 We will delete your information from the server of Dimond Pony Trading as soon as possible when we decide to respond to your deleting request. However, we will record and save your communication information only instead of using it due to the requirements of the regulatory authorities to combat crime and maintain national security. Please be aware that we may not delete the information you need to delete from the backup system immediately, but will delete it in time when the backup system is updated. Please contact the third-party to delete the resume directly delivered by the job-seeking user to the recruiting enterprise or the resume searched and downloaded by the recruiting user since cannot delete the information copied from the platform from the third-party server.

4.2.6 Unless otherwise provided by laws and regulations or otherwise agreed in the Policy, you can contact us through the methods mentioned in Article 9 of the Policy if you want to delete your other personal information or encounter difficulties in exercising the above rights. We will respond to your request after verifying your identity.


4.3 Cancel your account

4.3.1 Unless otherwise stipulated by laws and regulations or the Policy, you can cancel your Dimond Pony Trading account by clicking “Account cancellation” on the platform.

4.3.2 Please be informed that we will delete the personal information other than the personal information required to be retained according to laws and regulations in time or anonymize it after the account is canceled.

4.3.3 The cancellation of the account is irreversible. We will no longer provide you with products and/or services of Dimond Pony Trading, nor collect your personal information once your account is canceled. Therefore, we suggest that you should be cautious when canceling your account.


4.4 Restrict the automatic decision-making of information system and refuse directional push

4.4.1 We may make decisions for push based on non-manual automatic decision-making mechanisms, including information systems and algorithms. Please contact us through the contact information provided in Article 9 of the Policy if these decisions affect your legitimate rights and interests significantly.

4.4.2 Please understand that we can send you service-related announcements through the platform from time to time when we think it necessary (for example, suspension of service for maintenance). You cannot cancel these service-related notices or announcements that are not directional push.


4.5 Obtain the copy of your personal information

4.5.1 You have the right to obtain the copy of your personal information. You can click “My resume” – “Download” on the website of Dimond Pony Trading to obtain your resume.

4.5.2 Unless otherwise provided by laws and regulations or otherwise agreed in the Policy, you can contact us through the methods mentioned in Article 9 of the Policy if you want to obtain your other personal information or encounter difficulties in exercising the above rights. We will respond to your request after verifying your identity.


4.6 Respond to your request above

4.6.1 You can contact us through the contact information provided in Article 9 of the Policy to realize the user rights described in Article 4.1-4.6 of the Policy, or if you have any questions, complaints, advice or suggestions about the rights of your data subject. We may verify the identity of your identity (job-seeking user/recruiting user) before processing your request to ensure security. In principle, we will complete the identity verification, response and process within 15 working days after receiving your request.

4.6.2 In principle, we do not charge for your reasonable request. We will charge a certain cost for repeated requests within a certain period of time as the case may be; We will provide alternatives to requests that require many technical means (e.g. new systems need to be developed or existing practices radically changed), or have other significant difficulties.

5.5.1.1 Oppose the basic principles determined by the constitution;

5.5.1.3 Spread rumors, disturb social order and undermine social stability;

5.5.1.4 Spread obscenity, pornography, gambling, violence, murder, terror or abate crime;

5.5.1.5 Insult or slander others and infringe upon the lawful rights of others;

5.5.1.6 Incite illegal assembly, association, procession, demonstration and gather people to disturb social order;

5.5.1.7 Carry out activities in the name of illegal civil society organizations;

5.5.1.8 Contain false, harmful, coercive, invasion of others’ privacy, harassment, infringement, slander, vulgar, obscene, or other morally objectionable content;

5.5.1.9 Contain other contents restricted or prohibited by laws, regulations, rules, regulations and any legally effective norms.


5.6 It is prohibited to engage in the following activities with services of Dimond Pony Trading:

5.6.1 Enter the computer information network or use the resources of computer information network without permission;

5.6.2 Delete, modify or add functions of computer information network without permission;

5.6.3 Delete, modify or add data and application programs stored, processed or transmitted in the computer information network without permission;

5.6.4 Make and spread destructive programs such as computer viruses deliberately;

5.7 You agree to compensate Dimond Pony Trading, cooperative companies and affiliated companies for any claims, demands or losses claimed by any third party arising from or arising from the user’s violation of the Policy or relevant terms of service, including reasonable attorneys’ fees, and protect them from damage. The forms of legal liability borne by users include but are not limited to: compensating the infringed, and compensating the operating company of Dimond Pony Trading with the same amount after the operating company of Dimond Pony Trading undertakes administrative punishment or tort damage liability for damages caused by user behavior.

X. Supplementary provisions

User guarantees not to modify, rent, lend, sell, distribute the website and any of the above-mentioned materials and resources used on the website, or make any kind of articles based on the above-mentioned materials and resources without the express authorization of the company or the obligee.

(1) Recruiting products and/or services provided through the website of Dimond Pony Trading (dimondpony.com);

(2) Recruiting products and/or services provided by recruiting companies through Dimond Pony Trading;

(3) Other products and/or services we provide to you from time to time.


11. 3 User or You: refers to job-seeking users and recruiting users who use the products and/or services of Dimond Pony Trading.


11. 4 Minors: refers to minors under the age of 18.


11. 5 Personal information: refers to various information recorded electronically or by other means relating to identified or identifiable natural persons, excluding anonymized information. Personal information includes personal basic information, personal identity information, personal biometric information, network identification information, personal health and physiological information, personal education and work information, personal property information, personal communication information, contact information, personal online records, personal commonly used device information, personal location information, etc. For the avoidance of doubt, personal information includes, but is not limited to, sensitive personal information.
